    Hey I just wanted to ask you guys for some advice as I have only had my license for a month and someone crashed into the back of me on the motorway in slow moving traffic hit me at about 5-15mph the guy came out and agreed that it was his fault but the only thing is he hasn't got insurance.. Which is totally unfair for me because my insurance company told me to get the fixes I'd have to claim it through my own insurance making my premiums go up and having to pay the first £500 anyways which makes this totally unfair for me making the other guy who has no insurance not have to pay anything at all?

    Please can someone give me some advice thank you this happened in the United Kingdom so it will probably be different laws etc over here

    I mean, I know in America you hit them, you pay. If you don't have insurance... you really pay.

    Ask a cop. They know the laws, so they can tell you what you should do.

    We are going to call the police soon as the guy has become completely unresponsive via phone etc but I think I read somewhere that the maximum you have to pay without insurance is £1000 even then I would still have to wait for him to be able to pay that money so this is really unfair for me :/

    Tell the police, a similar thing happened with my mum, she simply told the police the situation and my mum ended up getting money

    You're always supposed to call the police in any type of car accident right away on scene, even if they have insurance or not. He should and will have to pay for any damages because he hit you from behind, and in most cases it's his fault. Pretty sure if he refuses to pay you can take him to civil court or whatever it is called and get an amount of money based on an estimate from wherever would fix your car.

    In the UK you're fucked.

    It's happened to my friend, he took the registration number and all his info and said, you're going to pay me now if you don't want me to report you and call the cops right now.

    He ended up paying for all the repairs and what not, still reported him i think.

    The government has setup some agency (MIB) which gives you compensation if you are hit by an un-insured driver I suggest if you have the correct details of the person to hand it to the police where they should make sure he loses his license but you know the police are shit so can't be for sure =] Uninsured Drivers' Agreement

    You also better have evidence such as pictures!
